The complaint maintains that belonging to the Government entails the duty to promote the prosecution of crimes
The lawyer Rubén Gisbert Fraile has filed a complaint in the Supreme Court against the second vice president of the Government, Yolanda Díaz, for the crime of omission of the duty to prosecute crimes in competition with the crime of concealment and embezzlement of public funds . Díaz, as a member of the Government, has the function of defending the institutions of the State which, this lawyer maintains, implies the promotion of prosecuting crimes that, according to him, is incompatible with the meeting he had with Carles Puigdemont in Brussels on September 4 , with the joint declaration of advocating political means to resolve the conflict and with the possible negotiation of an amnesty law, which would allow the independence leader to evade justice .
Gisbert points out that the vice president took Fax Lists the oath or promise to uphold and ensure that the Constitution is upheld and that both the supreme norm and Government Law 50/1997 include the defense of the State among their functions. “It is an inherent function of the entire Government to defend State institutions at all times (…) all of this added to the obligations inherent to every position belonging to the Public Administration to comply with and enforce the legal system, as well as the judicial resolutions,” states the text of the complaint, consulted by Economist & Jurist . According to this lawyer, every member of the Government has among his duties "not to fail to intentionally promote at all times the persecution of those responsible for the commission of crimes."
Remember that Carles Puigdemont is currently wanted and captured (he is actually under national arrest warrants, since the international ones have been deactivated pending a ruling from the CJEU) for an alleged crime of disobedience and misappropriation of public funds . These are crimes against the Public Administration, for which Díaz is responsible "and it is one of his functions and obligations to ensure at all times compliance with the law and the right in order to preserve and protect the institution." That function is incompatible, he says, with the desire to establish “a formula in which (Puigdemont) does not have to respond to justice for his criminally classified acts that attacked the State,” in exchange for support for the investiture. In this sense, she indicates, it is indifferent that she went to Brussels as a representative of Sumar, since she still holds the position of vice president .
